By using this Site, you agree to these Website Terms of Use (the “Terms”). If you do not agree to these Terms, please do not use the Site.

These Terms apply to your use of this Site and any content, free resources, or information available through the Site. If you become a coaching client and use our secure client portal (for example, Practice Better), your relationship as a client will be governed by our Client Agreement, Notice of Privacy Practices (NPP), and other client forms that you sign there.

1. Informational and educational use only

The content on this Site is for general informational and educational purposes only. It is not medical advice, diagnosis, treatment, or a substitute for professional healthcare.

Nothing on this Site creates a doctor patient, provider patient, or other regulated healthcare relationship between you and H Coach Health or any of our coaches.

You should always consult your physician or other qualified healthcare provider before starting, stopping, or changing any health, nutrition, supplement, medication, or exercise program because of information you have read on this Site.

If you have or suspect you have a medical condition, or if you are experiencing new or worsening symptoms, seek medical attention promptly. For emergencies, call your local emergency number.

2. No guarantee of results

Any examples, case stories, or testimonials on this Site reflect the experiences of specific individuals. Results vary by person and depend on many factors, including your starting point, health status, adherence, and other variables.

We do not promise or guarantee any specific outcomes, results, or improvements in health, weight, lab values, or other measures.

3. Eligibility and use of the Site

You may use this Site only for lawful purposes and in accordance with these Terms. By using this Site, you confirm that you:

• are at least the age of majority in your place of residence; and

• will not use the Site in any way that violates applicable law.

If you are a parent or guardian and allow a minor to use this Site, you are responsible for supervision and for ensuring that the minor understands that this Site is not medical care.

4. Intellectual property

Unless stated otherwise, all content on this Site is owned or licensed by H Coach Health and is protected by copyright, trademark, and other intellectual property laws. This includes text, graphics, logos, icons, images, audio, video, and downloadable materials.

• share links to public pages of the Site, provided you do not misrepresent our content or suggest we endorse you.

You may not, without our prior written permission:

• copy, reproduce, modify, publish, distribute, transmit, sell, or create derivative works from any content on this Site;

• use our names, logos, or branding in a way that suggests endorsement or affiliation;

• use automated tools (such as bots or scrapers) to extract large amounts of content from the Site.

If you submit content to us through the Site, such as comments, questions, survey responses, or messages (“User Content”):

• you are responsible for the User Content you submit;

7. No medical or professional client relationship through the Site

Your use of this Site, including sending us information via general contact forms or downloading free resources, does not create a medical, therapeutic, or professional client relationship with us.

A coaching client relationship with H Coach Health is formed only when:

• you are accepted as a client; and

• you sign the required client forms (such as the Client Agreement, Notice of Privacy Practices, and Assumption of Risk and Release of Liability) in our secure client portal.

Until then, your interaction with this Site and any general information we provide is not individualized advice.

8. Limitation of liability

To the maximum extent permitted by applicable law, H Coach Health, its owners, coaches, contractors, and staff are not liable for:

• any indirect, incidental, consequential, special, exemplary, or punitive damages; or

• any loss of profits, revenue, business, data, or goodwill,

arising out of or in connection with your use of this Site, reliance on Site content, or inability to use the Site, even if we have been advised of the possibility of such damages.

Subject to the paragraph below, our total aggregate liability to you for all claims arising out of or relating to the Site and these Terms, whether in contract, tort (including negligence), or otherwise, is limited to the amount, if any, that you paid to us for access to this Site in the twelve (12) months before the event giving rise to the claim.

If you are a consumer habitually resident in the European Union, the European Economic Area, or the United Kingdom, nothing in these Terms excludes or limits liability for death or personal injury caused by our act or omission, or for fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited under the mandatory laws of your country of residence.

9. Indemnity

To the extent permitted by law, you agree to indemnify and hold harmless H Coach Health, its owners, coaches, contractors, and staff from and against any claims, losses, liabilities, damages, and expenses (including reasonable legal fees) arising out of or related to:

• your violation of these Terms; or

• your misuse of the Site or reliance on Site content in a way that is inconsistent with these Terms.

This clause does not apply where it would conflict with mandatory consumer protection laws in your place of residence.

10. Governing law and jurisdiction

For visitors who are not consumers habitually resident in the EU, EEA, or UK, these Terms and any non contractual obligations arising out of or in connection with them are governed by the laws of the Province of Ontario, Canada, and the federal laws of Canada applicable in Ontario, without giving effect to conflict of law rules.

You and H Coach Health agree that the courts of Ontario, sitting in Toronto, have exclusive jurisdiction over any dispute arising out of or in connection with these Terms and your use of the Site, except where applicable law gives you a right to bring claims in another forum that cannot be limited by contract.

If you are a consumer habitually resident in the EU, EEA, or UK, the mandatory consumer protection laws of your country of residence will apply for your benefit. You may bring legal proceedings in the courts of your country of residence or in Ontario, Canada.

11. Changes to the Site and to these Terms

We may update the Site and these Terms from time to time. The “Effective date” at the top of this page shows when these Terms were last updated.

If we make material changes to these Terms, we will take reasonable steps to notify you, such as posting a notice on the Site. Your continued use of the Site after changes are posted means you accept the updated Terms.
